Mobile End User Licence Agreement

1. What this is, and what it incorporates
This End User Licence Agreement (the “Mobile EULA”) governs your use of the Bilt Mobile app for iOS (the “App”), provided by BuildingPP OÜ (registry code 17224732, Laulupeo tn 3-2, Tallinn, 10121, Estonia — “Bilt”, “we”, “us”).
The App is part of the Bilt service. The Bilt Terms of Service (bilt.me/terms, the “Terms”), the Bilt Acceptable Use Policy (bilt.me/aup) and the Bilt Privacy Policy (bilt.me/privacy) are incorporated into this Mobile EULA by reference and apply to your use of the App; capitalised terms not defined here have the meaning given in the Terms. How the App handles personal data is described in the Bilt Mobile Privacy Notice. If this Mobile EULA and the Terms conflict, this Mobile EULA prevails for the App; the Terms prevail for everything else. This order of precedence is subject to §6 and does not limit any right you have under mandatory consumer-protection law.
By downloading, installing or signing in to the App you accept this Mobile EULA and the documents it incorporates. You confirm that you are at least 18 years old or have the consent of your legal guardian, and, if you act for a legal entity, that you are authorised to bind it — as set out in the Terms.
2. Licence
We grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions (except that the App may be accessed and used by other accounts associated with you via Apple's Family Sharing or volume purchasing, where available). All rights not expressly granted are reserved. The restrictions in the Terms — including the prohibitions on reverse engineering, interference and circumvention of access controls — apply to the App.
3. Previews: what runs on your device
The App exists to run previews of applications built with the Bilt service.
- A preview is Customer Content, not Bilt Materials. The code that runs is the application you — or, in a team workspace, a collaborator — built with the Services. It executes on your device inside the App.
- You choose what to grant it. A previewed application may request device permissions (camera, microphone, photo library, location, motion). Those requests belong to the previewed application's features, and you grant or deny them at your own discretion; the Bilt Mobile Privacy Notice explains this in full.
- You run previews at your own responsibility. As the Terms state for Output generally, Bilt does not warrant that generated applications are error-free or secure, and does not review the content or behaviour of a preview before you run it. Previews are delivered to the App only from Bilt's preview infrastructure over encrypted connections. In a team workspace, running a collaborator's preview means running code you may not have authored — the same responsibility allocation applies between you and your collaborators.
- The Acceptable Use Policy applies to what you build and preview. We may suspend or terminate previews, or access to the App, on the grounds set out in the Terms and the Acceptable Use Policy.
4. No purchases in the App
The App sells nothing and processes no payments. Plans, pricing and billing for the Bilt service exist outside the App and are governed by the Terms.
5. Updates, availability and support
The App requires an internet connection and a supported iOS version. We may update, modify or discontinue the App as set out in the Terms (“Service Modification, Availability & Force Majeure”). Bilt is solely responsible for providing any maintenance and support services for the App, as set out in this Mobile EULA or as required under applicable law; support is provided at [email protected] — not by Apple (see §7).
6. Warranty, liability, termination
The disclaimers, limitation of liability, indemnification, termination and governing-law provisions of the Terms apply to the App, subject to §7 below and to any rights you have under mandatory consumer-protection law. This Mobile EULA terminates automatically when your right to use the Services under the Terms ends, and you may end it at any time by deleting the App and closing your User Account.
7. Apple-required terms
The following terms apply because the App is distributed through the Apple App Store, and prevail over anything inconsistent in this Mobile EULA:
- Acknowledgement. This Mobile EULA is concluded between you and Bilt only — not with Apple Inc. or its subsidiaries (“Apple”). Bilt, not Apple, is solely responsible for the App and its content. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.
- Warranty. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) you paid for the App; to the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are Bilt's responsibility, subject to this Mobile EULA and the Terms.
- Product claims. Bilt, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and use of it, including: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
- Intellectual property. In the event of any third-party claim that the App, or your possession and use of it, infringes that third party's intellectual property rights, Bilt, not Apple, is solely responsible for the investigation, defence, settlement and discharge of the claim, subject to this Mobile EULA and the Terms.
- Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties. The export-control and sanctions provisions of the Terms also apply.
- Third-party terms. You must comply with any applicable third-party terms of agreement when using the App (for example, your wireless data service agreement).
- Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of this Mobile EULA, and upon your acceptance of it, Apple will have the right (and will be deemed to have accepted the right) to enforce this Mobile EULA against you as a third-party beneficiary.
